In case of discrepancies, the Specific Terms shall prevail over this document.
Conditions for Using MostPlay
MostPlay grants you a limited license to access the site as long as you comply with this Agreement. Our site is not an offer or solicitation in any jurisdiction where such use is illegal.
You agree not to monitor, use, or copy our web content, hack into the site, or introduce malicious code. Unauthorized use or reproduction may be prosecuted.
Use of Our Services
You are responsible for any money lost from losing bets. It is your responsibility to check if you are allowed to bet with us based on your jurisdiction. You agree to use our services only for legitimate gambling purposes and not engage in any activity that damages our business or increases liability to us.
General Behavior
You will not use our services to transfer money between accounts through collusion. Notify us of any errors in bet calculations immediately. Do not interfere with the IP address or take actions to prevent us from knowing the actual IP address of the computer you use to access the site.
Consider any taxes or duties imposed on you as a result of your gambling transactions. Do not make abusive comments, use offensive material, or make defamatory comments on our site.
Privacy
Any information you send us will be processed according to our privacy policy. You authorize us to verify your identity and credentials with third-party information providers. We reserve the right to record all communications to and from MostPlay and verify any information related to gambling activities. You agree to indemnify and hold us harmless from any disclosure of personal information under this Agreement.
Betting Terms
You are responsible for understanding the content of our site and the operation of the Services. We reserve the right to resize the Services to improve them. We can determine when markets are open for betting and can close them at any time at our sole discretion.
You are responsible for the information you provide to us. We will not be liable for incorrect entries by you. If our operators repeat your bet request incorrectly, it is your responsibility to correct it. Once you confirm a bet and it has been matched, you are responsible for that bet if you lose.
MostPlay may suspend betting on any market at any time. We may also void certain bets or a market in its entirety to maintain integrity and fairness. Some users use programs to automatically place bets within certain parameters. Be aware that these bots can be active in any market at any time.
Cancellation, Termination, Suspension, and Default
We may restrict your access to MostPlay, suspend or terminate your account, withdraw your bets, void any pending bets, or cancel unmatched bets at any time at our absolute discretion. This can happen if:
- There is a technological malfunction
- We suspect illegal or fraudulent activities
- You breach any part of this Agreement
- You violate the terms of a MostPlay promotion
- You collude with other players
- You misuse “public market data”
- You are prohibited from participating in a bet under your employment contract or rules of a governing body
- You place a bet on a competition in which you participate
Under Age Gambling
It is illegal for anyone under 18 to register or bet on MostPlay. If we determine you are under 18:
- We will prevent you from making gambling transactions or withdrawing funds
- We will investigate the claim that you are a minor
Cancellation of a Bet Offer
Your cancellation of an unmatched bet will be effective once we send you a confirmation. If your cancellation request is not processed promptly, your offer may remain pending and available for acceptance. You might not be able to cancel your offer if your bet has been accepted in part or in full during the period between sending your cancellation request and receiving confirmation.
Minimum and Maximum Bet
Minimum and maximum bets depend on the product and market. These amounts are subject to change and may differ depending on the platforms used. Betting below the minimum threshold may lead to account closure.
Your betting limit is represented by your “Available To Bet” balance and “Exposure Limit” as shown in your account. If we process a bet outside the applicable thresholds, the bet will stand.
Settlement of Bets
We will settle markets by our rules and regulations. We reserve the right to reverse or change settlement if a market settles incorrectly. This may result in changes to your account to reflect the corrected settlement. If there are insufficient funds in your account, we may ask you to deposit funds to cover the outstanding balance.
Winnings or losses related to your bets will be rounded to the nearest two decimal places.
Commissions and Payment Structure
We charge a commission based on net profits in a market. Your stake for bets on the exchange is irrelevant to the calculation of the commission. Refer to MostPlay fees for how commissions and fees are calculated. We reserve the right to change our charges at any time.
Matters Beyond Our Reasonable Control
We are not responsible for any loss or damage resulting from force majeure, energy saving, commercial or labor disputes, government acts, telecommunications disruptions, or other delays beyond our control. We reserve the right to cancel or suspend services without liability.
We are not responsible for the failure of any equipment or software, regardless of cause, that prevents the Services from working.
Compensation
You agree to indemnify and hold us harmless from any liability, claim, loss, or demand by any third party arising from your breach of this Agreement or violation of any law or third-party rights.
Limitation of Liability
We exclude all representations and warranties regarding the quality and accuracy of the Services. We are not liable for any loss incurred due to the misuse of your password. Our liability is limited to your exposure limit as specified in your account. We are not liable for indirect, special, or consequential damages.
Nothing in this Agreement excludes our liability for death or personal injury resulting from our negligence.
Intellectual Property
MostPlay owns all copyrights and related rights to our site, including databases, pricing information, and related content. Unauthorized use may result in prosecution.
Information Services
MostPlay may provide access to various information and content, including form data, results, streaming video, upcoming events, scores, and other information related to sporting events. This information may be provided through our site, emails, or links to third-party websites.
Conditions as the “Information”
The information is provided by MostPlay or sourced from third parties. While certain information may be described as “live” or implied to be “live,” please be aware that such information may be subject to delays and may also be incorrect. Additionally, other MostPlay users might have access to faster and/or more accurate images and data than the provided information.
This information is provided “as is” and is intended for guidance only. To the fullest extent permitted by law, MostPlay makes no representations or warranties of any kind, including, but not limited to, the accuracy, quality, completeness, or timeliness of the information.
If you rely on the information to place bets, you do so at your own risk. MostPlay shall not be liable for any action you may or may not take as a result of your reliance on the information, or for any loss or damage (direct or indirect) that you may suffer as a result of your use of the information.
A link to third-party websites does not imply endorsement by MostPlay of any products or services available on such websites. You use such websites at your own risk, and MostPlay assumes no responsibility for the content or use of such websites.
Assignment
You may not assign any part of this Agreement without the written consent of MostPlay. However, MostPlay may assign this Agreement in whole or in part to any third party at any time. In the event of a transfer by MostPlay, we will notify you of this change, and if you do not agree, you will not be able to continue using our services, but you may withdraw your funds at any time subject to these Terms.
Divisibility
If any provision of this Agreement is found by any competent authority to be unenforceable or invalid, the relevant provision shall be amended to enforce it by the intent of the original text to the fullest extent permitted by applicable law. The validity and enforceability of the remaining provisions of this Agreement shall not be affected.
Conflict Resolution
In the event of a dispute between you and us, each of us agrees to follow the procedure outlined in our Dispute Resolution Policy, as amended from time to time.
Amendments
We reserve the right to make immaterial changes to our site and all manuals and policies on our site, including this Agreement, at any time.
No Waiver
No failure or delay by any party to exercise any of its rights under this Agreement shall constitute a waiver thereof, and no exercise of any part of such right shall constitute any other or greater exercise of that or exclude any other right.
Applicable Law and Jurisdiction
MostPlay is regulated under the Curacao Gaming Board. MostPlay operates in accordance with the applicable laws and regulations but please keep note that we will not be responsible for any users’ non-compliance with the law. It is up to players to learn and comply with all the laws and regulations pertaining to the online gaming regulations in your jurisdiction.
